Please read these Terms of Service (“Terms”) carefully before using our platform, authentication systems, software-as-a-service (SaaS) tools, and related services. By registering, accessing, or using GrowthClicks (including logging in via third-party providers such as Google), you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our services.

1. Acceptance of Terms

By creating an account, accessing, or using GrowthClicks, you affirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and possess full legal capacity to enter into a binding agreement. If you represent an organization or business entity, you represent and warrant that you have full legal authority to bind that entity to these Terms.

2. Description and Scope of Services

GrowthClicks operates a modular Software-as-a-Service (SaaS) ecosystem designed to provide digital utilities, performance analytics, and operational tools, which may include but are not limited to:

  • Order & Packaging Verification Systems: Cloud-assisted video recording, media storage, tracking, and operational workflow tools.
  • Network Diagnostic & Traffic Simulation Utilities: Proxy-based routing, uptime monitoring, latency diagnostics, and web traffic simulation tools.
  • Web Performance & Search Engine Analytics: Website speed testing, Core Web Vitals diagnostics, technical auditing, and SEO metrics.
  • Centralized Identity & Access Management: Single Sign-On (SSO) and authentication infrastructure across our network of applications.

We reserve the right to modify, expand, restrict, suspend, or discontinue any module, feature, tool, or service at our sole discretion at any time without prior notice or liability.

3. User Accounts and Authentication

  • Registration and Accuracy: You agree to provide accurate, current, and complete information during registration or OAuth sign-in (e.g., via Google).
  • Credential Security: You are solely responsible for safeguarding your login credentials, API tokens, and access rights. Any activity conducted under your account is your sole legal and operational responsibility.
  • Third-Party Providers: When using Google Sign-In or other identity providers, you authorize us to authenticate your identity in strict accordance with our Privacy Policy and third-party developer policies.

4. Specific Service Disclaimers and Operational Rules

4.1 Traffic Simulation, Proxy Utilities, and Network Testing

  • Authorized Targets Only: You warrant that you own, operate, or have express legal permission to route traffic, simulate requests, or run diagnostic testing on any target URL, domain, or IP address you configure in the Platform.
  • No Malicious Use: You shall not utilize our proxy or traffic simulation services for Distributed Denial of Service (DDoS), credential stuffing, click fraud, unauthorized scraping, ad-network manipulation, or circumventing technical security measures of third-party platforms.
  • Third-Party Penalties: GrowthClicks is not responsible for any domain blacklisting, IP bans, ad-network suspensions, search engine penalties, or service terminations imposed on you by third parties as a result of your use of our simulation or proxy tools.

4.2 Media Storage and Packaging Video Management

  • No Archival Guarantee: While GrowthClicks provides media storage tools for order packing and operational verification, our service does not constitute an immutable or permanent archival vault. You are solely responsible for maintaining local backups of critical evidence.
  • Dispute Resolution: We make no warranties that recordings generated or stored via our tools will be accepted as conclusive evidence by third-party marketplaces, payment processors, couriers, or arbitration bodies.

4.3 SEO Auditing and Performance Metrics

  • Advisory and Diagnostic Nature: SEO recommendations, speed scores, and technical audit data are provided for informational and diagnostic purposes only.
  • No Ranking Warranties: GrowthClicks makes no promises or guarantees regarding search engine indexing, search rankings, organic traffic volume, or business revenue outcomes.

5. Acceptable Use and Prohibited Conduct

You agree that you will NOT:

  1. Violate any applicable domestic, foreign, or international laws, regulations, or third-party terms of service.
  2. Probe, scan, exploit, reverse-engineer, decompile, or attempt to derive source code from our IdentityServer, API endpoints, backend services, or underlying infrastructure.
  3. Introduce malicious software, trojans, worms, logic bombs, or automated exploits against the Platform.
  4. Resell, lease, sublicense, or redistribute access to the Platform without prior written authorization from GrowthClicks.
  5. Impersonate any individual, organization, or misrepresent your affiliation with any entity.

6. Intellectual Property Rights

All software, algorithms, architecture, user interfaces, documentation, visual designs, trademarks, and service content available on GrowthClicks are the exclusive intellectual property of GrowthClicks and its licensors. You are granted a limited, revocable, non-exclusive, non-transferable license to utilize the SaaS tools for your legitimate business operations in compliance with these Terms.

7. Third-Party Integrations and External APIs

Our Platform may integrate with or link to third-party services (such as Google OAuth, search engines, external proxy providers, and cloud hosting infrastructure). We exercise no control over, and assume no liability for, the availability, security, uptime, policies, or actions of any third-party provider.

8. Account Suspension and Termination

We reserve the unrestricted right, without prior notice or liability, to suspend, terminate, rate-limit, or permanently delete your account, API access, or stored data if:

  • You breach any provision of these Terms or acceptable use policies.
  • Your activity generates abnormal load, security threats, legal liability, or reputational risks to GrowthClicks.
  • Mandated by law enforcement, regulatory directives, or court orders.

9. Disclaimer of Warranties (“AS IS”)

To the maximum extent permitted by applicable law, the GrowthClicks platform and all associated SaaS modules are provided strictly on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, statutory, or otherwise.

GrowthClicks disclaims all express or implied warranties, including but not limited to:

  • Merchantability, fitness for a particular purpose, non-infringement, and title.
  • Uninterrupted, timely, completely secure, error-free, or bug-free operations.
  • The absolute accuracy, completeness, or reliability of any diagnostic reports, simulation results, or analytics outputs.

10. Limitation of Liability

To the fullest extent permitted by applicable law, under no circumstances shall GrowthClicks, its founders, directors, employees, affiliates, agents, or licensors be liable for:

  • Any indirect, incidental, special, consequential, exemplary, or punitive damages.
  • Any loss of business profits, data loss, downtime, customer churn, goodwill, domain blacklisting, or third-party marketplace penalties.
  • Any unauthorized access to, alteration of, or loss of your stored media, videos, or account transmissions.

In all circumstances, GrowthClicks’ total aggregate liability arising out of or related to these Terms or your use of the Platform shall be strictly capped at the total amount actually paid by you to GrowthClicks for the specific service in the three (3) months preceding the incident (or fifty US dollars ($50.00 USD) if you used a free tier).

11. Indemnification

You agree to defend, indemnify, and hold harmless GrowthClicks, its affiliates, and their respective officers, directors, employees, and contractors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising out of or related to:

  1. Your use or misuse of the Platform and any of its modules (including traffic simulation, proxy utilities, and media uploads).
  2. Your violation of these Terms.
  3. Your violation of any third-party rights, including intellectual property, target server rights, privacy, or terms of service of target websites.

12. Future Expansions and Modifications to Terms

GrowthClicks continuously evolves its SaaS ecosystem. We reserve the right to introduce new features, alter existing services, or update these Terms at any time. Any changes become effective immediately upon posting to https://growthclicks.work/terms (or associated identity endpoints). Your continued use of any service after updates constitutes explicit acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the applicable laws of our operating jurisdiction, without regard to conflict of law principles. Any legal disputes arising under these Terms shall be resolved exclusively within the competent courts of that jurisdiction.
